Terms of service.

1. ‘mjp creative’ is Monique Pattison trading as mjp creative.
2. ‘The Client’ is the party making a booking for design related services from mjp creative.

3. ‘An Order’ is the request for services from mjp creative.

4. ‘The project’ is a term used to describe service from mjp creative.

The terms and conditions apply to all dealings between The Client and mjp creative. By placing an order with mjp creative, you as a Client are forming a legally binding contract for services and you agree to the following terms & conditions.

QUOTATIONS

All quotes are valid for 14 days. All prices are excluding GST unless otherwise stated. All prices are in Australian Dollars. Any additional work outside the terms of the quote will be charged at an hourly rate of $100 per/hour. mjp creative is not responsible for increases in materials by third party services (eg printers, packaging suppliers, web developers) where the increases are beyond our control.

If the Client wants to change the scope of work after acceptance of this agreement, client shall send designer a written change order (detailed, in one email) describing the requested changes in detail. Within ten (10) days of receiving a change order, designer will respond with a statement proposing designers availability, additional fees, changes to delivery dates, and any modification to the terms and conditions.

PAYMENTS

Up-front payment is required for all projects $500 or under. Projects $500 and over are paid over two instalments; 50% non-refundable booking deposit and 50% payment upon project completion. All invoice terms are 14 business days from the date of the invoice. Accounts which are not paid on time will incur a late administration fee of $50 + GST. Accounts which remain outstanding for 14 days after the date of invoice will incur an additional payment fee equivalent to 5% of the projects costs for each week payment is outstanding. Final artwork files will not be handed over until the final invoice has been paid in full. All work not completed within a 3 month period will be invoiced regardless. Payment is required for any artwork or drafts, that have been terminated on your request at any stage of development, prior to completion. Invoice will be issued as ‘work to date’. If debt collection is required for unpaid invoices, The Client is responsible for any costs incurred (fees/commissions payable to the debt collectors).

CANCELLATION

The Client may cancel this Agreement for any reason by providing a minimum of 10 days written notice to mjp creative, any deposit paid prior to cancellation will be non-refundable. mjp creative may cancel this Agreement at any time for any reason by providing written notice to The Client. In the event that mjp creative cancels this Agreement, mjp creative will provide any artwork completed and paid for to date.

PROJECT RESTART

A 50% rescheduling fee will be applied if you do not provide completed content by the start date and your project will be postponed until the next available spot in the project queue. If you do not respond at all or provide content within 3 days of the start date then your project will be cancelled until further notice until we can have a chat about what happened and then we discuss the next steps from there. 

COMMUNICATION

mjp creative is an online business therefore the majority of our communication is made via email, this helps me keep track of specific design requirements & any changes required. If you would like to chat with me on the phone or via zoom I am happy to do so, however I ask that you please email me and make an appointment for a time to chat.

DESIGN CREDIT

The Client allows mjp creative to display any projects on the mjp creative website/ instagram page/ and portfolio for self promotion purposes. The Client agrees to allow mjp creative to credit design work on all websites designed by mjp creative. The Client agrees to allow mjp creative to add a small credit on the Client’s website. This will be in the form of a small line of text, and will be placed towards the bottom of the web page.

TURNAROUND TIMES

mjp creative will make every effort to meet deadlines. All quoted turnaround times are approximate. mjp creative will not be held responsible or liable for any costs resulting from late artwork or printing deliveries.

DESIGN REVISIONS

Brand and Graphic Design
mjp creative will provide the Client with two (2) rounds of minor refinements with no extra cost within seven (7) days of submission to the Client for review. (“Review Period”). Minor refinements include colour changes, font swapping between concepts or a minor font change, changes to size or hierarchy, and adding or removing of a graphic element. Request for minor changes are to be made via e-mail. mjp creative will presume that the Client has accepted the original draft with no changes, if no emails requesting changes were made within seven (7) days of the commencement of the review period.

Website Design
mjp creative will provide the Client with three (3) rounds of minor refinements with no extra cost within seven (7) days of submission to the Client for review. (“Review Period”). Minor refinements include colour changes, font changes, switching out images, textual changes, small alterations to movement of elements on the website, change of images. Minor refinements do not include adding extra pages, custom CSS, third party plugin integration, extra content uploads that were not originally covered under the original project brief. Request for minor changes are to be made via e-mail. mjp creative will presume that the Client has accepted the original draft with no changes, if no emails requesting changes were made within seven (7) days of the commencement of the review period.

APPROVAL

Approval is required for all projects, via email prior to work being released. Whilst all care is taken by mjp creative, mjp creative is not responsible for any spelling, grammatical, numerical errors or omissions after final approval. Even if these errors are from mjp creative, it is the Client’s responsibility to proof read and check thoroughly their projects to identify any errors prior to approval.

COLOUR MATCHING & PRINTING

Whilst all care is taken, mjp creative does not take responsibility for Client supplied artwork that does not print properly. Please note that colour on projects can vary from screen to final product. Screen proofing is not indicative of final printed piece. Printed colours can vary from printer to printer, job to job, run to run, or even front to back, due to the nature of the CMYK printing process.

WEBSITES

The Client is to refer to hosting and domain name providers for queries regarding the following services: Domain names, hosting and registration, SSL certificates, email addresses and email hosting. The Client is to refer to their technical support company for queries regarding the following services and their applicable Terms & Conditions: Set up of email addresses, Emails going to Spam/Junk, Email not functioning and Email Signatures. mjp creative holds no responsibility if: (a) your email addresses are targeted with spam as it is outside of our control or (b) the Client’s email account details are obtained and used to send spam or malicious material. mjp creative build and design websites to the best of their knowledge at the time of completion. We shall not take responsibility if the Client’s site is “hacked” or maliciously attacked in form. mjp creative will not be held responsible and is not liable for any loss of income to arise from the Client’s web site “going down”, being hacked or otherwise.

IMAGES

Some designs may contain stock images that are available for purchase. Any images supplied by the Client must be provided in high resolution and preferably in CMYK. mjp creative is not responsible for colour variations in conversion from RGB to process CMYK. mjp creative is not responsible for the reproduction quality of supplied images.

FONTS

In order to produce an authentic and aligned brand, some designs may be produced using purchased fonts. In order for the Client to have full rights to using the font, the Client will need to purchase the font license.

NO GUARANTEES

mjp creative cannot guarantee the outcome of design services and the client’s comments about the outcome are expressions of opinion only. The Client acknowledges that mjp creative cannot guarantee any results for design as outcomes are based on subjective factors that cannot be controlled by mjp creative.
